1. Agreement to these Terms
These Terms & Conditions (“Terms”) are a binding agreement between you and Brevvie LLC, the operator of the Everly Lane discoverability-audit service (the “Service”). By checking the acceptance box, creating an account, or using the Service, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service.
You represent that you are at least 18 years old and, if you use the Service on behalf of an organization, that you are authorized to bind that organization to these Terms.
2. The Service
Everly Lane produces automated “discoverability” audits that analyze a business’s public online presence and generate scores, findings, and suggestions. The Service relies on third-party data sources and automated and AI-assisted analysis, which may be incomplete, out of date, or inaccurate.
3. Not professional advice; results not guaranteed
The Service is provided for informational purposes only. It is not legal, financial, marketing, SEO, or other professional advice, and it does not guarantee any particular outcome, ranking, traffic, revenue, or result. You are solely responsible for any decisions or actions you take based on the Service.
4. Fees, billing, and refunds
Certain audits are paid. Prices are shown before purchase and are charged through our third-party payment processor. Charges appear on your statement from “Brevvie,” the software platform on which the Service runs. Except where required by law, all fees are non-refundable once an audit has been unlocked or delivered. You authorize us and our processor to charge your selected payment method for the amounts you approve.
5. Your responsibilities and acceptable use
You agree to provide accurate information, to have the right to submit any URL or business you audit, and not to misuse the Service — including no unlawful, infringing, or abusive use, no attempts to disrupt or reverse-engineer the Service, and no use that violates a third party’s rights or any applicable law.
6. Intellectual property
The Service, its software, and its content are owned by Brevvie LLC and its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes. You retain ownership of the business inputs you submit and grant us the license described in the Privacy Policy to operate and improve the Service and the broader Brevvie suite.
7. Third-party services and data
The Service integrates third-party providers (for example, search and mapping data, hosting, analytics, AI model providers, and payment processing). We are not responsible for third-party services, their availability, or the accuracy of data they supply, and their own terms may apply.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY RESULT OR SCORE IS ACCURATE OR COMPLETE.
9. Assumption of risk
YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISK ARISING FROM YOUR USE OF THE SERVICE AND YOUR RELIANCE ON ITS OUTPUT. YOU ARE SOLELY RESPONSIBLE FOR EVALUATING, AND FOR ANY CONSEQUENCES OF, ANY ACTION YOU TAKE BASED ON THE SERVICE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Everly Lane, Brevvie LLC, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES (THE “COMPANY PARTIES”) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE COMPANY PARTIES’ TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE SPECIFIC AUDIT GIVING RISE TO THE CLAIM — OR, IF YOU PAID NOTHING, ONE U.S. DOLLAR (US$1.00). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Indemnification
You will defend, indemnify, and hold harmless the Company Parties from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your content or inputs, or your breach of these Terms or of any law or third-party right.
12. Data use
We do not sell your personal information. We do use account, usage, and audit data to operate, secure, and improve the Service and other software across the Brevvie suite of services and Brevvie LLC’s wholly owned products, as described in the Privacy Policy.
13. Suspension and termination
We may suspend or terminate your access at any time, with or without notice, including for any suspected violation of these Terms. Sections that by their nature should survive termination (including Sections 8–16) will survive.
14. Governing law; arbitration; class-action waiver
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Any dispute will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small-claims court. YOU AND THE COMPANY PARTIES WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Any claim must be brought within one (1) year after it arises.
15. Changes; miscellaneous
We may update these Terms; material changes take effect when posted, and continued use means acceptance. If any provision is unenforceable, the rest remains in effect. These Terms are the entire agreement between you and us regarding the Service.

1. Who we are
Brevvie LLC operates the Everly Lane service. This Privacy Policy explains what we collect, how we use it, and your choices.
2. Information we collect
Account information (name, email, workspace, password hash). Audit inputs you provide (such as business names, websites, and locations). Usage and device data (log data, IP address, timestamps, and interactions). Payment information is collected and processed by our third-party payment processor; we do not store full card numbers on our systems.
3. How we use information
To provide, secure, maintain, and support the Service; to process payments; to communicate with you; to comply with law; and to develop and improve the Service and other software across the Brevvie suite of services and Brevvie LLC’s wholly owned products (including model, quality, and product improvement).
4. We do not sell your information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We may use de-identified or aggregated data, which is not personal information, for any lawful purpose.
5. When we share information
With service providers/subprocessors who work on our behalf (for example, hosting, payment processing, analytics, email, and AI model providers), under confidentiality obligations. To comply with law or valid legal process, or to protect rights, safety, and the integrity of the Service. In connection with a merger, financing, or sale of assets, subject to this Policy.
6. Retention and security
We keep information for as long as needed to provide the Service and for legitimate business or legal purposes, then delete or de-identify it. We use reasonable administrative, technical, and physical safeguards, but no method of transmission or storage is completely secure.
7. Your choices and rights
You may access or update account information, and you may request deletion, subject to legal exceptions. Depending on where you live, you may have additional rights; to exercise them, contact legal@brevvie.com.
8. Cookies, children, and international use
We use necessary cookies and similar technologies to run and improve the Service. The Service is not directed to children under 18. If you use the Service from outside our operating region, you consent to processing where we and our providers operate.
